Warranty conditions
I. General
In addition to the statutory warranty that consumers are entitled to from their seller, Wesco (Naber GmbH, Enschedestr. 24, 48529 Nordhorn) grants consumers this geographically unlimited manufacturer’s warranty for Wesco products. This applies without prejudice to mandatory statutory liability provisions, such as under the Product Liability Act (Produkthaftungsgesetz), in cases of intent and gross negligence or due to injury to life, limb or health by Wesco or its agents.
For the purposes of this manufacturer’s warranty, a “consumer” is any natural person who has become the owner of the product and has concluded the purchase for a purpose which is not mainly attributable to their commercial or self-employed professional activity. The “first customer” is the consumer who first purchased the product (new goods) from Wesco, from a dealer or other natural or legal person who resells the product in the course of their commercial or self-employed professional activity (collectively “Dealer”).
For purchases made on wesco.de, we are the direct point of contact for warranty claims. If you purchased the Wesco product elsewhere, you must first contact the original seller to make your warranty claim.
II. Warranty protection
This manufacturer’s warranty applies to Wesco products purchased by first customers on or after 01.03.2025 (proof of purchase) and for which the warranty period is stated on the box/packaging or in the product description in the WESCO online shop at www.wesco.de.
Wesco guarantees consumers that its products are free of material, manufacturing and construction defects. For this, the state of the art in science and technology at the time of manufacture is decisive. The product must have already exhibited the defect that caused the damage at the time of the transfer of risk. Claims for compensation for consequential damage or product liability only exist in accordance with mandatory statutory provisions.
This warranty is valid for a period of 5 years from the date of purchase by the first customer. The warranty period is not extended as a result of the provision of services under this warranty, in particular repair or replacement of a product or part of a product. The warranty period does not start again in these cases either.
III. Written notification of defects
The consumer can assert their rights under this warranty within the warranty period by submitting a written notification of defects to Wesco or the dealer from whom the first customer purchased the product. It is the responsibility of the consumer or first customer to prove that the warranty has not expired by presenting the first customer’s proof of purchase. The notification of defects to Wesco is to be sent together with the proof of purchase to the following address (preferably by email):

IV. Performance in case of warranty
Wesco can choose to repair the product, replace it or send a replacement part to the consumer.
If Wesco decides to carry out the repair and sends written confirmation of this, Wesco bears the resulting costs for spare parts, its own labour costs and the shipping of the product. The consumer is to make the product available.
In case of replacement, the product is replaced free of charge by a new product of the same type, quality and model. If the product is no longer manufactured at the time the defect is reported, Wesco is entitled to deliver a similar product.
If Wesco chooses to send a replacement part, Wesco bears the cost of the replacement part including the shipping costs.
V. Requirements and exclusions
The effectiveness of the warranty is subject to compliance with the operating instructions and use of the Wesco products in accordance with the technical instructions, usage and care instructions from Wesco. Technical instructions, usage and care instructions are included with every product and are available at www.wesco.de.
The warranty does not cover:
- wearing parts, such as springs, foot pedals, etc.;
- consumables, such as batteries;
- minor deviations from the specified properties, which have no influence on the utility value of the product;
- operating errors, damage due to aggressive environmental influences, chemicals, cleaning agents, intense sunlight;
- defects to the product caused by transport and trial operation;
- damage caused by the defective Wesco product;
- B-grade products, used products.
- non-compliance with the technical instructions, usage and care instructions provided;
- product damage caused by the seller or third parties;
- damage due to normal wear and tear or intentional and negligent damage;
- improper commissioning;
- use of replacement parts or accessories not authorised by Wesco;
- insufficient or incorrect maintenance/care;
- products which have not been or are not used for their intended purpose;
- damage caused by force majeure or natural disasters, in particular, but not limited to, fire, hail, theft, floods, earthquakes;
- purchases in open electronic marketplaces such as, for example, but not limited to, Ebay and Amazon, as well as purchases from garage sellers, second-hand shops, etc.
VI. Non-application of the warranty
If a product defect proves to be outside the scope of this warranty, the costs of shipping and transporting the product are to be borne by the consumer. This does not apply if the consumer proves that, under the circumstances, he was unable to recognise that the warranty claim was not valid. If, after being informed that the warranty does not apply and of the probable costs of the repair, the consumer wishes the repair to be carried out, they are also to bear the costs of spare parts and labour.
If the product was not already defective at the time of the transfer of risk, Wesco decides in each individual case whether to rectify the defect as a gesture of goodwill. In this case, the consumer has no legal claim to rectification of the defect.
VII. Statutory rights
In addition to rights under the warranty, the consumer is entitled to the statutory rights. These are not limited by the warranty. The warranty is also without prejudice to the rights that the first customer has against the seller from whom the first customer purchased the product.
VIII. Place of performance, place of jurisdiction and applicable law
This warranty is subject to the laws of the Federal Republic of Germany. This choice of law does not apply to the mandatory consumer protection regulations of the country in which the consumer has their usual place of residence. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) of 11.4.1980 is excluded. The place of performance for the obligations arising from this warranty is Nordhorn. If the consumer does not have a general place of jurisdiction in Germany or if their domicile or habitual residence is not known at the time the action is brought, the exclusive place of jurisdiction for all disputes arising from this warranty is Nordhorn.
